Bankruptcy and Debt 45%

Consumer debt can be dealt with by a bankruptcy filing or the development of a manageable repayment plan. Learn what might be best under your unique circumstances.

Chapter 13 Bankruptcy 25%

Create a debt repayment plan over a period of 36 or 60 months. Unlike consolidated credit counseling and the like, if debt isn't paid off in full at the completion of the repayment plan, the remaining is wiped away as long as you made all required payments under the plan. This is a good option to get caught up on your mortgage, car payments, or pay for taxes without penalties and interest.

Chapter 7 Bankruptcy 25%

Get out of debt by liquidating your property. The good news is I usually can save all of your property from liquidation. If I can't, I'll explain what to expect in a Chapter 7 Bankruptcy or whether a different kind of bankruptcy would be beneficial.

Appeals 5%

If you believe the decision of the trial court was wrong and didn't properly apply the law to your case then an appeal to a higher court, like the Court of Appeals or Supreme Court, is a course of action to get a just result.

Posted by Helen | April 26, 2019 | Hired Attorney | Chapter 13 Bankruptcy

Never can reach him and he doesn’t return phone calls or emails.

We filed Chapter 13 a little over two years ago. Since that time my husband has become disabled, we moved and I have a lower paying job. We can’t meet the payment schedule that was set up and fell behind. We have tried calling him to discuss options but our phone calls aren’t returned. We are so ...disappointed with his service and don’t want anyone else to have the same problems.

I'm sorry you feel that way. I note from the email correspondence that I always responded to you timely and explained the options available to you. Ultimately I can't make decisions for you. I can only advise and make suggestions. My job is to lay out the options and what we need to do to complete the chosen option. I understand that you may not like your options, but bankruptcy law gives us certain requirements that must be followed. These were explained to you. It is explained to all potential clients that I will respond immediately to email and text messages. Since I am a solo attorney with offices in Lincoln and Omaha, my availability by phone is limited and I would prefer not to spend that time playing phone tag. All clients are encouraged to schedule a phone call at a specific day and time. That way we don't have to constantly be trying to call each other back over several days. In conclusion, records show that I responded to you and provided your options in a timely and professional manner as I do with all of my cases. If you would like to discuss more you can contact me or schedule a meeting online by going to www.caldwell-lawfirm.com/schedule.
