Kevin Mark Smith

Kevin has over 15 years’ experience representing clients in high-stakes employment and business litigation in state and federal courts throughout the country. His practice focuses on representing corporate clients involved in business and employment-related disputes, such as wage and hour, discrimination and harassment, retaliation, public policy whistleblowing, non-competition and similar covenants, breach of contract, and breach of fiduciary duty. He has defended numerous class actions and other multi-plaintiff lawsuits, including complex multi-district wage and hour litigation and several discrimination matters brought by the Equal Employment Opportunity Commission.

Kevin also defends clients facing complaints made through state and federal agencies, such as the EEOC, the Missouri Commission on Human Rights, the Department of Labor, and others, and he has represented clients in alternative settings, such as binding arbitration and mediation processes many times with excellent results.

From these experiences, Kevin has developed a keen perspective on developing policies and strategies to help employers avoid employment-related litigation. He frequently advises clients on the handling of difficult personnel matters, policy reviews, wage-and-hour audits, and the full range of issues touching on the employment relationship. And because of his breadth and depth of employment-law and litigation-related knowledge, Kevin often presents to clients, industry groups, HR professionals, and fellow attorneys regarding developments in these areas of law.
