Like the other types of cases, these matter can become quite complex and, many lawyers will not take them because the client is often found to be partially at fault.     Wrongful death is a cause of action created by the legislature and did not exist at common law.     These cases ARE both complex and very difficult to win. The are also very expensive to prepare and try to a conclusion. Therefore, we are VERY selective of the types of malpractice case we accept. Recent changes in the law by the legislature, including caps on non-economic damages and changes in joint and several liability make these all the more difficult to handle economically. You must have serious, permanent economic damages (bills and lost wages) or we will not accept your case.

It has happened to me and my family:


  1. My father was killed by a young driver who was under the influence of alcohol when I was 21. The horrific damage and effects of that accident are damaging my family today, as you read this message. The accident happened 39 years ago. I know what happens when a loved one and a bread winner is killed at the hands of a negligent driver.
  1. My daughter was involved in a terrible accident wherein she sustained bilateral skull fracture and a traumatic brain injury. While my daughter is doing remarkably well, I watched first hand as she struggled to recover regain some control of her life. I know what it is like to watch a loved one struggle to rebuild her life.

Mr. DeVoto's representation in our serious case
From the first day of our disaster to THIS day (that has been over 7 years now)......Mr. Devoto has been not only caring, concern AND proactive...he is NOT a lawyer that takes the money and runs. Since the settlement that he totally supported us through..he still is our friend and highly respected counsel for ANY issues that we have.
