“This action was due to a misunderstanding of the rules concerning trust accounting. A number of years ago the Supreme Court initiated a Rule that requires all "unearned" fees to be placed in the lawyer's trust account. Thereafter, the funds can be removed as the fee is earned. The funds are to be placed in the lawyer's general fund prior to disbursement. I paid the "earned" fees directly to myself or creditors without taking the additional step of placing the funds in the general account.”
