No way an IL lawyer can know how another state would handle Il offenses. Need to check with the state where you are "wondering" about.

is it my understanding it is an "infraction" in WI, not a crime but check with a WI lawyer to be certain.

yes, an arrest is not required in order to charge someone with a criminal offense. Most likely the police are awaiting lab test results. They are...
