Nightmare Experience Adam M. Mergenthaler at Horwitz and Horwitz

Adam M. Mergenthaler appeared on my case for another lawyer from Horwitz and Horwitz. He appeared in place of Dave Starshak who was the lawyer that was one of the primaries on the case. Adam alleged the motion was unopposed. As the client I had opposed any extension past 9/2019. So the motion was NOT... unopposed however, I guess the clients wishes aren't a consideration for Mergenthaler and Horwitz. I'd put in writing that my financial situation wouldn't allow for an extension of the trial date. The motion was contrary to what the client requested and as the client I had no idea that Horwitz had requested an extension past 9/2019. The Motion to extend the trial date to 12/2019 was denied. Adam Mergenthaler's appearance on the motion resulted in him having to file an Affidavit denying what Opposing Counsel put in an affidavit as to an alleged meeting of the minds regarding experts. Even though settlement talks were underway, all that went down the drain after the Affidavit problem regarding medical experts. Extending a trial date past the date that the client indicated she could tolerate due to finances is NOT a strategy call especially since lawyers had the case since March of 2017 to do what was required as it relates to medical experts. The Affidavit debacle was about the medical experts. Mergenthaler should not appear on any case unless he is clear on what communications with the client were as to the extension of the trial date. Mergenthaler has never offered to remedy the problems his appearance caused me as a client. It's not that difficult to put oneself in the shoes of the client especially once in financial trouble.
