You have to wait until October 1 and there isn't really any good way to work for them lawfully as far as I know.

It doesn't sound like an issue, She should just let the USCIS know she made an error. No reason to refile.

You can file a petition as a permanent resident but there is a long waiting list. Doesn't matter where you get married but he won't be able to...
