It is OK to apply with an expired green card. You're still a resident. I'd suggest hiring an attorney so you don't have issues in the future.

Doesn't sound like it. That's not abuse. Sounds like you'd get a divorce and move on.
A US company isn't supposed to pay you directly as a consultant. That sounds problematic.
