Cases change through their course. When someone is counter-sued in a case (meaning that they bring a lawsuit and the defendant responds by suing them back), if the defendant's claim has good legal support, it might be in the client's best interest to settle if they have more to lose than gain. I will always employ a diligent strategy of fully analyzing a case as it changes to prevent harm to my client. In the rare cases that (1) the scope of the case changes such that there is no prospect of recovery, and (2) the client wants to prove a purely personal or emotional point and expects me to spend my time in accomplishing that goal, you can expect I will openly and honestly counsel the client that litigation is not for settling personal or emotional disputes - it is for advancing a legal claim that presents a good possibility of recovery. I will always act in my clients' best interests. In the exceptionally rare case (such as this one) where the client's interests in going forward, and mine in honoring my ethical duties as a lawyer to only pursue claims that are legally and factually supported, do not converge, I will recommend to the client that they seek other counsel, who will pursue their goals if they align ethically.
