In all sincerity, I just want the best for my clients. Most of the situations that lead to criminal charges start off as a misunderstanding, or a situation that unnecessarily escalates to unforseen levels. Many times I counsel invidivuals who simply didn't understand the law and were doing what they thought was legally correct at the time of thier arrest. And worst of all, quite a few of my clients land in my office because they didn't know how to properly assert thier constitutional rights. The biggest example of this is allowing a police officer to search your person, and your car, by freely giving them consent to do so. In order for them to invoke their authority to legally search you, they have to have enough information available to them to articulate the probability of criminal activity reaching a level high enough (probable cause standard) to override your 4th amendment right against Unlawful Search and Seizure. Simply stated, if you haven't done anything wrong, and are just going about your business being an upstanding citizen, the police shouldn't be asking to invade your privacy and breach your constitutional protections by talking you into allowing them to search your car. Always say no, respectfully. If they search anyway, and they find something which lands you in jail, you come see me as soon as you get out. We'll handle it.
