Melissa, I understand your frustration with the fee process. However, the fee structure for a Social Security case is set by Section 42 of the United States Code and is not set by me or my office. In addition, I always explain to my clients that the fee for the case is 25% of any back pay your are due and you signed a fee agreement agreeing to that amount. Social Security automatically withheld the first $6,000.00 of the back pay and sent that out as partial payment for my fee. The Judge who decided your claim then requires me to petition for the remainder of the 25% of the back pay if it equals more than $6,000.00. Again, this is all set by the Federal Code and not my office. That is why it seems as though two fees are being paid, when in reality, the total of my fee is still equal to 25% of your total past due benefits, which is the fee set under Section 42 of the USC. Also, please keep in mind that I represented you for over 5 years on this claim with several court and appeals court proceedings which required an inordinate amount of work, time, effort and expenses. If we billed you at an hourly rate, your fee would be much higher than the $10,947.21 fee that I am due in your case. Moreover, every other area of law that works on a contingency fee is allowed a fee of 33.3%, not the 25% we can charge in a Social Security claim. Again, I understand your frustration in this process and I want you to know that it is equally frustrating for the attorneys as I have still not been paid the remaining $4,947.21 I am due despite winning your case in October 2021! If Social Security would just send the attorney the full 25% right after the case is won, it would save a lot of complications and frustration. However, their rules require a fee petition for any fee over $6,000.00. I hope this helps explain the process and helps you understand that the fee in a Social Security case is set by the Federal Government and is lower than a fee in any other area of law.

I am sorry that you weren’t happy with my representation and that you thought I was not listening to your questions. I try very hard to answer every question I receive from all of my clients and I have never cut a client off in the middle of a question to say, “ok, thanks for calling.” I apologize if this is how you felt. As for the expenses, it is written into the fee agreement that every client signs and that I go over with every client and it states that if your doctors or medical providers bill us to get copies of your medical records, we will then bill the client for those costs when we close the file. Even though we are allowed to bill for other expenses, such as postage, copies, etc, we do not bill for those. Moreover, I have waived those bills in many cases where a client has called regarding such. Since this was an anonymous review, please feel free to contact me regarding the bill for expenses.
