In early 2010, our home suffered moderate damage due to a lightening strike. Favorable Settlement
Policyholders won, and were allowed to have their amount of loss dispute decided by appraisal, not by State Farm.
The policyholder won, and its claim was paid (along with interest and some attorney fees). The Court of Appeals issued an extremely favorable opinion which because it is "published" is binding on lower level courts any time the same issues arise.
Plaintiff defeated defendant's attempt to bar claim based on statute of limitations and the case subsequently resolved favorably.
