Andrey T. Tomkiw

Andrey T. Tomkiw has dedicated his legal career to representing employers in labor and employment law cases, and in related business matters. A significant portion of his practice is dedicated to assisting human resource professionals in the implementation and administration of workplace policies, with an emphasis on compliance with ADA, FLSA and FMLA regulations.

Mr. Tomkiw frequently counsels clients on a range of important issues including workplace violence, sexual harassment, substance abuse and employee benefits. He has represented employers in front of numerous state and federal agencies, including the EEOC, NLRB, MDCR, UA, MiOSHA, MERC, OFCCP and the Wage & Hour Division of the Michigan Department of Labor & Economic Growth.

Mr. Tomkiw possesses extensive experience representing employers in traditional labor law matters. He has appeared on multiple occasions before the National Labor Relations Board and Michigan Employment Relations Commission. Mr. Tomkiw frequently advises business owners and other professionals on handling unfair labor practice charges, developing and implementing strategies for collective bargaining and navigating the privatization of public sector work. He also specializes in grievance and interest arbitration, mediation and fact-finding.

In addition to his traditional labor law experience, Mr. Tomkiw has also represented employers in employment litigation matters involving issues such as ERISA, Title VII, the Elliott-Larsen Civil Rights Act, the Whistleblowers Protection Act and the Bullard-Plawecki Employee Right to Know Act. His experience also includes counsel on wiretapping statutes, privacy issues, constitutional rights, successful enforcement of non-compete agreements and various commercial disputes.

Mr. Tomkiw is highly skilled in workplace investigations and effective discovery during litigation and is a staunch client advocate in the courtroom. He has appeared in both State and Federal Courts and has handled appellate work for the Michigan Court of Appeals, the Michigan Supreme Court, 6th Circuit Court of Appeals and the United States Supreme Court.

He is an active member of the Southeast Michigan community and holds leadership positions at a number of area organizations, including:  President of  the Royal Oak Chamber of Commerce (serving on both the Executive and Legislative Committees), Royal Oak Downtown Development Authority, Chair of the Royal Oak Task Force for Development and Permitting, Board Member of  Boys and Girls Club of South Oakland County,  member of the Troy Chamber of Commerce Golf Committee and the Red Run G&CC Membership Committee.  Additionally, Mr. Tomkiw is a graduate of the Detroit Regional Chamber Leadership Detroit program, class XXV.  In 2009, Andrey Tomkiw was also named one of the Top Attorneys in Michigan, for Labor and Employment Law, by Michigan Super Lawyers, dbusiness Magazine, and Hour Detroit Magazine.

Mr. Tomkiw resides in historic Pleasant Ridge, with his wife, an engineer for the Department of Defense, and three children. When not practicing law, he enjoys working on his golf game or finding that perfect wine.
