Terrible Lawyer

In our initial meeting for my divorce, I was told there was no way I would end up in a position where assets were not divided fairly, especially considering the length of the marriage--nearly 50 years--and that, generally, things would be handled in a 50/50 manner regardless of the source of funds. B...ased on that understanding, I moved forward with confidence in the process. However, during the Zoom meeting with my ex-spouse and her attorney, the direction changed significantly. When her attorney stated her position regarding the house and inheritance, I felt that I was strongly encouraged to accept those terms rather than having my position more firmly advocated. I repeatedly heard that I should "just take it" because it was the best I was going to get. Looking back, I regret not reviewing his client feedback before retaining him. My experience aligns closely with the concerns others have raised. Throughout this process, I often felt that communication was dismissive and, at times, condescending rather than supportive or advisory. I was also disappointed in the level of preparation and representation during our Zoom meeting. It did not appear that he was fully prepared, and much of the discussion involved reviewing materials I had already provided, rather than advocating my position with a clear strategy. I would never recommend Martin!! He's a terrible lawyer.

Very uninvolved in the entire process

Martin is personable and professional until you pay a retainer and then loses all interest in the case. I was required to negotiate on my own behalf while Martin sat to the side offering more support to the other party than he did for me. The entire office lacked the ability to relay messages or pr...ovide any coherent response to questions. Information or documents provided were filed but were never reviewed or referenced during any meetings. I hired Martin for a Family Law matter and if this is all the effort he puts into his cases I would highly recommend that you represent yourself since you will already be doing alk the work.. It definitely would have turned out much better for myself as the legal result would have been the same and I would have saved the cost of a significant retainer.

Professional misconduct

This lawyer was disciplined by a state licensing authority in 2012.

Public Reprimand issued in IN, 2012

updated on 03/12/2019

A reprimand means an attorney did something wrong but may still practice law. The State gives the lawyer a public reprimand in hopes that he or she will not repeat the behavior. Details of the infraction are made part of the public record.

Martin’s comment:

“Regarding the public reprimand cited in 2012 from a November 2007 retainer agreement. Attorney McCloskey was disciplined for the use of the language "non-refundable retainer" as opposed to a "flat fee" or "refundable retainer." A retainer is a deposit towards services and must be earned. A flat fee agreement is an agreement to perform services for an agreed fee. Attorney McCloskey has adjusted all language in retainer agreements to clarify and separate retainer and flat fee agreements.”
