Partially Probated Suspension issued in TX, 2010

updated on 08/05/2015

Partially Probated Suspension means an attorney lost his or her license to practice law for a period of time. When the attorney returns to practice, he or she will be on probation, meaning the State monitors the attorney's activities for a period of time in hopes that he or she will not repeat the behavior.

F. Benjamin’s comment:

“I resigned from practicing in Texas rather than litigate the 2 claims against me. I returned to Ohio where we had yet to sell our house. The first claim resulted from a client who delayed cashing a refund check. The second client accised me of failing to fiel a timely charge with the EEOC. I admitted I miscalculated the date.”

Suspension For Term issued in OH, 2010

updated on 08/05/2015

Suspended for term means an attorney lost his or her license to practice law for a period of time. The attorney typically returns to practicing law when the suspension expires.

F. Benjamin’s comment:

“My suspension expired in December 2010. I accepted the suspension because I issued a settlement check to a client that was returned NSF from my trust account. I promptly made the check good. The overdraft occurred because I added a deposit twice into the account. No client funds were ever missing or misused.”
