Conflict of inte

Mr. Schneider is representing a family member against me. However he has been my lawyer for years. Furthermore one of his assistance is also a family member and his receptionist is a family member. I feel this is very shady on his part and should not be able to practice law where there are family mem...bers involved. I feel he should be removed from the case due to conflict of interest.

Due to the commenter choosing to remain anonymous, I can only guess as to what case this applies. I think this is an estate matter where I represent the estate. My job is to ensure the terms of the will are carried out. As such I represent all the heirs. In this instance the will of the deceased parent, prefers one child over the other. The Commenter is unhappy with his bequest. The law requires that the intent of the will be carried out. Just because he thinks he should have been left more does not make this an adversarial matter. If he hired a lawyer and filed a will contest a conflict of interest could arise, but at present there is no conflict of interest.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
