I hired Veronica Fair-Miller to handle a Chapter 7 Bankruptcy. I thought everything was going well until my discharge. She assured me the accounts I wanted to reaffirm (keep) were being reaffirmed. She LIED!! She discharged ALL my accounts including my home and my car! So now, I have ZERO accounts to...
Reaffirmations in bankruptcy are primarily intended to allow the filer to KEEP secured items such as houses, cars, furniture, or jewelry despite discharging all other debts. When a filer signs a Reaffirmation Agreement, they are promising to pay that debt in full no matter what happens in the future. So if you should lose your income for any reason before that debt is paid, no additional bankruptcy filing will protect you as it relates to that debt. Bankruptcy stops creditors from making negative reports on your credit in the future. Making continued timely payments to creditors for reaffirmed debts can help you rebuild your credit with good reports. HOWEVER, bankruptcy law does not require creditors to report anything in the future. Most creditors will, but some simply will not. A filer can contact the credit bureaus & provide proof of payments to help boost their standing with a creditor on their own. This would be ideal with an item such as a car. As it relates to mortgages, I do not advise clients to sign these in case they should lose their income and cannot satisfy such a large debt; but if they so desire, they most definitely can. I will also advise filers to use credit wisely after discharge. Good payment history can boost your credit score. While I represent individuals who desire relief or a discharge from certain debt under the bankruptcy code (which is exactly what I did in this case), I do not represent individuals as it relates to credit repair.
