City v. M-Client Stopped at 2:35A.M., DUI, Open Container, Breath Refusal-Dismissed

Client was stopped by a municipal police officer, at 2:35A.M. for Improper Lane Usage. Upon approaching vehicle, officer noted an open container of alcohol and an intoxicated passenger. Officer opine ... d that client had an odor of alcohol on his breath, slurred speech, glassy eyes and demonstrated unsteady balance upon exiting vehicle. Client was arrested for DUI and also cited for Open Container and Improper Lane Usage. At the jail, client refused the breath test. Upon pre-trial negotiations, both the DUI and Open Container cases were dismissed with prejudice.
