Suspension issued in AL, 2019
updated on 08/29/2022
This means the attorney lost his or her license to practice law for a period of time. The attorney typically returns to practicing law when the suspension expires.
Mark's comment: “The period of time in question was during the three year illness and subsequent death of my wife due to ovarian cancer. I chose not to pursue an aggressive argument against the allegation due to the timing of the allegation.”
Reprimand issued in AL, 2009
updated on 12/16/2017
This means the attorney did something wrong, but the State did not suspend the lawyer. Typically in this case the lawyer's poor behavior is exposed to the public in hopes that he or she will not repeat the behavior.
Mark's comment: “I represented a gentleman in Mississippi. My client entered into a plea agreement and was placed on probation. From the beginning, I was given special permission to represent him. Later, I had to appear before the same Mississippi court on a probation violation for my client on the same identical case. Technically, it appears I should have received permission again to represent client in this matter but I did not. The district attorney in Mississippi wrote a letter to Alabama State Bar.”
Stayed Suspension/Probation issued in AL, 2006
updated on 12/21/2017
Stayed suspension/probation means an attorney did something wrong but may still practice law. This type of suspension means the attorney has been suspended, but that the suspension is placed on hold (and ultimately removed) if the attorney complies with certain requirements. In this case the State also monitors the lawyer's activities for a period of time in hopes that he or she will not repeat the behavior.
Mark's comment: “Due to an unknown status regarding a possible tax liability with IRS, I was advised by my IRS representative to temporarily close all of my bank accounts. This included my Trust Account which had a $275.00 balance. This information was conveyed to the Alabama State Bar which reviewed the matter and stated my reason to close the account was inadequate. Subsequently, the Alabama State Bar took the action they deemed appropriate.”
