First of all, Greg Kramer does nothing, his Clerk (Wayne) does all of the work. BUT the clerk does not go to Court. I know this client and she is a very loving Mother. She was forced to raise her son for a meaningful period of time without the support of the biological legal Father. She came to me with a difficult case, seeking to limit if not prevent the Father from coming back into the young Son’s life. After all, the Mother had remarried a lovely Man and she with him had raised the son without much help or interference from the Father. From day one, before I was retained, I counseled the Mother my client, that, it would be extremely difficult to prevent a reunification with the Father. But put yourself in her shoes. She adored her son and had done all the heavy lifting in and towards his care. Our day in Court was very unfortunate. From the beginning the Court was not sympathetic to our request to reunite the Son and Father slowly over a period of time. The Father presented extremely well, as he had obtained an education, established that he had never abandoned his Son and now wanted a significant time-sharing with the Son over parts of summer, holidays and when he could come to Bradenton as he lived out of state. The Father’s requests were reasonable under the law and facts as they applied to the law. Naturally, I was adamant and sincere in attempting to achieve my client’s desires. Unfortunately, the Court was unsympathetic and not convinced by our factual presentation. I could see that we were losing ground with the court and I needed to salvage what we could. I suggested and the Court did allow the parties and attorneys to meet in private to attempt reaching a settlement. The Father and his attorney offered the original terms which significantly limited the Father’s time with his Son. I vehemtly urged the Mother to accept the offer. She refused and insisted on being heard further. After exhausting all favorable questions, I allowed the Mother to go into narrative, without any objections from the other side. She was given free reign over 30; minutes to explain uninterrupted why it would harm the child to see the Father. She miserably failed and angered the Judge to the point he admonished her and ordered her to take special parenting classes. Yes the proceeding that day produced a disfavorable outcome and further was a little disconcerting as I allowed the Mother to simply express out of frustration in her own words why the court should restrict the Father rights to the Son. In conclusion, here we have a very nice but naive client, seeking a very difficult goal and sabotaging her own case by not following her attorney’s advice.. After the hearing the Mother was extremely rude to me. It was clear she had lost all confidence in me. She accused me of being on the Father’s side. My law clerk was showing additional fees were due. In totality of the circumstances I suggested to my client she might want to retain a different attorney and I would forgive any additional fees due. To save money and in light of Father living out of town very little discovery had been conducted before trial. At trial the Mother’s version simply did not hold up. Ultimately the parties’ reached an agreement. The good news is the Son will have two good parents and a very close step- Father. I wish all the parties’ well.
