After previously dealing with the harsh reality of a DUI license suspension, my hopes were not very high for winning a 2nd refusal appeal. From the moment I retained Musca Law, Rebecca and her team has provided me with the representation one could only hope for. After an hour long hearing, the case is deliberated on and then decided by one DMV hearing officer. The threshold for overturning a refusal to blow can sometimes tip to the side of unfairness, because the hearing officer will not fully consider all aspects of the case and default to a nonreversal. If I lost the challenge, I would enter a 90 cold period where I cannot drive whatsoever, after which my license would still be suspended for a year, and I would have to reapply for a hardship license. I fully expected to lose the challenge and started to prepare for how I would live my life without driving anywhere for three months. Ms. Sonalia performed hours upon hours of thorough research into case law in building my defense. She attacked my case from numerous legal angles finding all possible defense opportunities. During the hearing, she rigorously questioned the police officers involved in my arrest and illuminated new pertinent facts not reported in their arrest packet. Using this information coupled with her vast experience and hours of research into similar prior case decisions, Ms. Sonalia illustrated to the DMV Hearing Officer that my DUI arrest did not meet the legal requirements. About a week after my hearing date, the DMV sent back correspondence that the DMV administrative hearing officer decided to overturn my one-year license suspension. I would not be serving my 90 cold period, no more hardship license, and my full driving privileges and license was 100% reinstated. I still have to fight the charge in criminal court, but this first win provides a reassuring sense of hope. I couldn’t be more thrilled about having my driver’s license back.
