Land use / zoning attorneys help you understand land use laws and zoning regulations, both of which concern how you use your land (for businesses, homes, farms, factories, etc.). Kathleen “Katie” Berkey is a Florida Bar Board Certified Specialist (BCS) in City, County and Local Government Law and a certified Professional Planner by the American Institute of Certified Planners (AICP). Ms. Berkey is the only practicing professional to hold both credentials in Southwest Florida and one of eight statewide. She represents clients in zoning, land use, and planning matters, including: representing clients in local government administrative matters before city and county commissions, councils, and boards; environmental resource and water use permitting; local and state code compliance; and private and government contracting and negotiation. As a certified Professional Planner, she is qualified to provide expert witness testimony on zoning, land use, and planning issues. Ms. Berkey also represents condominium, cooperative, and homeowners’ association clients with the management and operational aspects of governing their communities, as well as zoning and land use matters. This specialty encompasses the preparation of laws, ordinances, regulations, and legal instruments, as well as addressing legal issues of county, municipal, other local governments, special districts, agencies, or authorities, such as: land use and zoning, taxation, sunshine law, public records law, eminent domain, sovereign immunity, and procurements.

Attorney, consultant and friend
Katie has steered our condominium association through amendments of our declarations and by laws. She has protected the association rights and property through a protracted rezoning and development process from a new developer that purchased the neighboring property. She was always available and had the uncanny ability to speak at the level of her audience. Katie is just a nice caring attorney that has earned the title of friend.

Mortgage re-fi of 10 unit commercial property
Mrs Berkey represented my interests in confronting a nasty and confrontational bank holding my original mortgage. I would've been overwhelmed and abused without her
