My Practice Areas:
I have been practicing law in Florida for over 35 years, and in the past 30 years I have limited my practice to the representation of construction industry clients. The types of matters I handle include, but are not limited to, the following: construction contract/subcontract preparation, review and negotiation; dispute avoidance counseling; dispute resolution prior to arbitration or litigation; the mediation, arbitration and litigation of all types of construction disputes, including lien foreclosure, payment bond claims, performance bond claims, breach of contract claims, delay claims, acceleration claims, and interference claims. Throughout my carrer I have represented commercial and residential developers, design professionals, home builders and residential and commercial contractors, specialty contractors (typically as subcontractors) in all divisions of construction, as well as materials and rental equipment suppliers.
I have 12 years of experience as an arbitrator, and as a mediator, with the American Arbitration Association, was certified as a Circuit Court Mediator by the Florida Bar, was board certified by the Florida Bar as an expert in Construction Law, and served as a Special Master to preside in the capacity of an administrative law judge over evidentiary hearings on citations and administrative complaints filed with the Pinellas County Construction Licensing Board against unlicensed as well as licensed construction contractors from 2008 to 2012. As Special Master I presided over more than 400 evidentiary hearings.
For more information on my practice, please visit my website at . In addition to a description of my practice, you will find forms to be completed to request a construction Claim of Lien or Notice of Nonpayment.
Why Construction Law?
I have always had a fascination for construction, but soon after I began practicing law I developed a tremendous respect and admiration for the decent, honest, hard-working, and courageous people I met in the construction industry. I saw that these people take tremendous financial and personal risks in providing the labor, services and materials necessary for the construction of the homes, commercial and industrial buildings, infrastructure, and roadways we all take for granted every day. After the first few years in the practice of law, I began to limit my litigation practice to the area of construction litigation. Despite having represented clients in thousands of construction-related matters and disputes over the course of my career, I enjoy the unique issues and factual and legal challenges each new project brings, and learning new things about design, engineering, and both horiztontal (site and utilities) construction and vertifical construction.
Court Admissions:
In addition to being admitted to practice in all state courts in the State of Florida, I am admitted to practice before the U.S. District Courts for the Northern and Middle Districts of Florida, the U.S. Court of Appeals, Eleventh Circuit, and the U.S. Supreme Court.
Education:
I was born in Bristol, Virginia and entered King College in Bristol, Tennessee, after my junior year in high school on an early admissions program and full scholarship. I transferred to Virginia Commonwealth University in Richmond, Virginia after my freshman year, where I was very active in leadership roles within my academic department as well as the university at large. I received a Bachelor of Science Degree in Administration of Justice in 1981, with High Honors, graduating first in my class of over 2,100 students. While at V.C.U., I was a member of Phi Kappa Phi national honor society, the American Criminal Justice Honor Society (Lambda Alpha Epsilon), and Laurels Honor Society.
I attended the University of Virginia, School of Law in Charlottesville, Virginia, where I received my Juris Doctor degree in 1984.
Personal:
I raised two now-adult sons as a full-time single parent since they were 2 and 3 years old. Family has been and always will be a priority for me.
I have been involved in youth organizations as a T-ball and Little League baseball coach and serving as the Cubmaster of a large Cub Scout Pack for many years. My hobbies have been numerouis and varied and include: hiking, backpacking, camping, marksmanship, fishing (freshwater, inshore and offshore), canoeing, kayaking, powerboating, woodworking, metal detecting and travel. I have collected numerous tems as a hobby before selling them to create room for the next interest, including, diecast vehicles, coins, stamps and Native American artifacts found in Florida. At one time I had over 15,000 authentic Florida arrowheads, spearheads, tools made from shells, tools made from deer antler and deer bone, complete pottery pieces and other artifacts. I was trained in artifact authentication by one of the country's most renowned and published artifact authenticators.
