David Constantino

David is a Senior Attorney with the firm of Rahdert & Mortimer, P.L.L.C.

David has 18 years of legal experience.  He has extensive experience in both federal and state courts in multiple jurisdictions.  These multiple jurisdictions include Massachusetts, Florida, and Colorado.

David has negotiated numerous cases to settlements in the areas of commercial and civil litigation.  As an attorney for the State of Florida he negotiated numerous Stipulation and Consent Agreements concerning violations of Section 517, Florida Statutes, in the form of fines, cease and desist orders, and permanent bars.   In addition to an administrative capacity, David’s experience includes Securities Law in state and federal courts.   David has obtained monetary settlements for clients involving Securities Law actions.  He has defended numerous clients involving Securities Law related violations, including allegations of insider trading.  David has advised advisory firms and broker dealers on all related business and corporate matters including all compliance related matters, drafting of corporate minutes, and necessary corporate filings.

His experience further includes the representation of clients in five FINRA/NASD arbitrations (4 wins 1 loss).  He served as lead counsel and conducted the arbitration and all evidentiary issues associated with these actions.   David has settled over 20 FINRA claims and was accepted as an Arbitration Panelist for FINRA in 2012.   In addition to Securities Law David has negotiated significant monetary settlements for numerous cases involving personal injury matters, as well as obtaining numerous monetary settlements defending breach of contract claims on behalf of technology consultation companies.   

David’s transactional experience includes real estate closings both residential and commercial as well as the sale and purchase of small businesses. 

David has probated a number of estates in both Florida and Massachusetts.
