Most recently, in November 2014, Joe obtained a 26.7 million dollar verdict as lead counsel in the Southern District of Florida on behalf of four clients who suffered injuries from Boston Scientific's Pinnacle Pelvic Floor Repair Kit. The Pinnacle mesh kit is implanted for the treatment of stress urinary incontinence and pelvic organ prolapse. Each client was awarded an average of 6.6 million dollars in compensatory damages due to injuries suffered from the defective design of the product.
With over two decades of trial practice, and an Ivy League pedigree, Joe Osborne has the experience and education to match the best litigators in the state - both on a resume and, more importantly, in the courtroom.
But Mr. Osborne brings another key advantage to every case he takes on: As a former partner at a personal injury defense firm, he has a unique insight on how the other side thinks. It enables him to understand - and overwhelm - the best defense strategies and tactics.
A former adjunct professor of business law at Palm Beach Community College, Mr. Osborne also understands that being able to explain complicated legal principals in simple language - whether to students or a jury - is one of the most potent tools a lawyer can possess. And also one of the most rare.
A skilled trial lawyer, Mr. Osborne knows that cases are often won or lost before they ever go before a jury. To that end, he puts a heavy emphasis on the deposition stage, aggressively yet carefully deposing hostile witnesses to extract the answers and information that can resolve a case quickly and justly for his client.
The case may always be the focus, but the client will always be the priority. Empathetic to their difficult situations, Mr. Osborne knows that a lawyer who isn't responsive to his clients' needs or queries isn't doing the job. Exceptional legal knowledge combined with first-rate personal service isn't a goal - it's essential. And it's what Mr. Osborne brings to every case he takes, and every client he helps.
Mr. Osborne previously served as liaison counsel and a member of the Plaintiff’s Steering Committee in the Trasylol MDL No. 1928, pending in the United States District Court for the Southern District of Florida. He was actively involved in all aspects against Bayer Pharmaceutical including document review, depositions of Bayer witnesses, expert preparation and presenting and taking depositions of experts. I also prosecuted one of the bellwether cases from that litigation (Rodriguez v. Bayer, Case No. 1:08-MD-01928) which was settled before trial.
Mr. Osborne serves on the Plaintiffs’ Steering Committee for : (1) Zimmer Nexgen Knee Products Liability Litigation (MDL No. 2272) before the Honorable Rebecca Daumeyer pending in Chicago, Illinois; (2) Biomet M2a Magnum Hip Implant Products Liability Litigation (MDL No. 2391) before the Honorable Robert L. Miller, Jr.; and, (3) Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation (MDL No; 13-2441) before the Honorable Donovan W. Frank.
He has been appointed to the Plaintiffs’ Steering Committee in the In Re: American Medical Systems, Inc., Pelvic Repair Systems Product Liability Litigation (MDL No. 2325); In Re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (MDL 2187); In Re: Boston Scientific Corp. Pelvic Repair System Products Liability Litigation (MDL 2326); In Re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (MDL 2327) all before the Honorable Chief Judge Joseph R. Goodwin pending in Charleston, West Virginia. He has tried to verdict two bellwether transvaginal mesh cases against Boston Scientific which involved reaching a verdict of $26.7 million in Miami, Florida in November, 2014.
Joseph Osborne has also been involved in several other mass torts and played a vital role in:
Black v. Ethicon, et al., Case No: 502004CA002466XXXXMB (lead case) against Johnson and Johnson involving Intergel (a surgical product).
Holtsberg v. Citigroup, et al., Case No: 502004CA00837XXXXMB (lead case) involving securities losses due to diminution in value of World Com stock.
