Estate Plans need to be customized base on each individual's objectives and situation. Estate plans can be used for: Financial Planning, Health Care Decisions, Tax Planning, Planning for Minor Children, Medicare and Medicaid Planning, and more. Wills and Trusts are just some of the tools that can be used in Estate Planning. Estate Plans can range from simple plans to very complex ones.

Everyone should have a Will. Even those with a Living Trust should have a "pour-over-will". In addition to a Will, everyone should have: a Durable Power of Attorney (for financial planning), a Designation of Health Care Surrogate (for health care decisions), and a Living Will.

Probate is the process of administering an estate. Not all estates require probate, but a careful review needs to be done to ensure assets and liabilities are handled correctly. In Florida, there are different forms of probate, ranging from formal administration to administration for small estates. If multiple heirs/beneficiaries are involved, Florida requires an attorney to handle probate administration.
