Scott D. Smiley is a Registered Patent Attorney, holds a degree in Electrical Engineering, and, in addition to his daily legal practice, teaches Patent Law at Nova Southeastern University's Law Center. Mr. Smiley was part of a team that litigated a three-year long patent infringement case against The Home Depot U.S.A., Inc., where they successfully proved that The Home Depot engaged in willful patent infringement. In 2010, after a nearly month-long trial that made news across the nation, the jury awarded the client $15 million in actual damages. To that, the Court added an additional $3 million in punitive damages, $2.8 million in attorneys' fees, $3.1 million in prejudgment interest, and over $300k in costs, for a total award of almost $25 million.
This year, Scott was named to the list of Florida's "Super Lawyers" by Super Lawyers Magazine (limited to top 5% of Florida's attorneys). For the past five years, Scott has been named by Florida Trend Magazine as one of Florida's Legal Elite (limited to top 2% of Florida's attorneys).
Mr. Smiley's qualifications include years of real-world experience working in various fields of engineering as well as several years serving as a professor of engineering courses at a local South-Florida college.
Mr. Smiley frequently co-counsels with other law firms, giving them the ability to utilize the Concept Law Group's experienced registered patent attorneys whenever needed. Scott is a member of the Florida Bar, the Patent Bar, the American Bar Association, and the Intellectual Property Law Association of Florida and sat on the Florida Bar's committee for Intellectual Property Law.
