David Benjamin is a managing member of Benjamin & Melmer, LLC. Before forming the firm, Mr. Benjamin served as a Prosecutor in Miami-Dade County, Florida for more than six years. Mr. Benjamin spent almost three of those years as the Division Chief of the Misdemeanor Domestic Violence Unit. In that capacity, Mr. Benjamin trained and mentored more than 50 attorneys, while simultaneously overseeing all aspects of the unit. Such supervision included approving plea deals, trying cases, and overseeing all aspects of a case from the filing decision to trial strategy. Mr. Benjamin is thus inextricably familiar with how the Miami-Dade State Attorney’s office makes filing decisions, plea deal decisions, and decisions on whether or not to pursue a case to trial. Because of Mr. Benjamin’s time and experience with the domestic violence unit, Mr. Benjamin has had the opportunity to view, and understand, the intersection between criminal and family law that can occur. In addition to managing the Misdemeanor Domestic Violence Unit, Mr. Benjamin has also prosecuted all forms of criminal cases at every level, including DUIs, simple assaults/batteries, armed burglaries, armed robberies, kidnapping, possession of drugs, sex offenses, narcotics trafficking, murder, and other violent crimes.
Mr. Benjamin has also served as a member of the Advisory Board of Dial-A-Life, an organization dedicated to the distribution of life-saving communication devices to domestic violence victims and the elderly of our community. Mr. Benjamin is a member of the Florida and Dade County Bar Associations and the League of Prosecutors. Mr. Benjamin is also an active member of the University of Florida Levin College of Law’s Alumni Counsel.
Mr. Benjamin graduated with highest honors from the University of Florida in 2001, where he earned a Bachelor of Arts degree in history. In 2005, he earned his Juris Doctorate from the University of Florida Levin College of Law, where he graduated cum laude. During law school, Mr. Benjamin served as the Managing Editor of the University of Florida’s Journal of Law and Public Policy and as a research assistant for Dean Emeritus Jon Mills.
Mr. Benjamin is a member in good standing with the Florida Bar and is admitted to practice in all circuit courts throughout the State. In addition, Mr. Benjamin is also a Supreme Court Certified Civil Mediator
