Complete Fraud

Sure....they filed the trademark application, but only after making me do my own research. So I submit my findings and low and behold.....my application gets denied because of one of my findings. Called them multiple times to follow up with their "Application Guarantee"...I hadn't been called back. E...ventually, I called to ask for my refund, minus filing fees (as promised by their "Guarantee") Obviously, they didn't call me again. This law office is an absolute scam and should be avoided at all costs. If it worked for you, it's only because you had a patent or trademark that was seamless and required NO WORK to push through. Unless you want to be taken for $1500, I would keep looking if I were you.

Unprofessional behavior

This lawyer is very unprofessional. He was very pushy during a call to sell his service and then he backpedaled and refused service he promised using a completely false excuse. There are better lawyers, keep walking and searching...

Great for flat-fee services

Early last year, I contacted Mr. Rapacke as a result of the great reviews on Avvo. I was involved in my very first serious legal issue as a business, and needed representation/counsel for an Intellectual Property dispute. I had many questions, and he was generous with his time. I offered to pay for s...everal hours of that time in advance due to the amount of calls and emails I knew I'd be placing, to which he politely ignored or refused. He was very adamant about making me feel comfortable by letting me know that my case was solid. The first sign of trouble was when Mr. Rapacke sent out a Cease and Desist letter that had terms in it from previously discarded edits. Even though it was pointed out prior to being sent, the wrong terms were still officially communicated. It also wasn't sent out on the agreed upon time, which caused issues due to time sensitivity. Things really started to go south when the possibility of actual litigation arose. My question, verbatim, was: "Before proceeding, can I inquire as to the how experienced you guys are with this type of thing? A few things have caused some hesitant concern; should we end up litigating/suing, what is the track record for your firm with cases like this? I just want to make sure that I'm in the best position I can be.. thanks in advance for any input." Mr. Rapacke's answer, verbatim, was: "Our firm has been more than generous in taking multiple calls without charging, calling Mr. [REDACTED] last minute, and getting things turned around very quickly. I am not in the business of trying to convince anyone to use our Firm. With that being said you may be more comfortable going to another Firm. In which case I am happy to provide them with whatever documents they may need. Have a great day." I reached out to him once more, but it was clear he no longer wanted to conduct business as a result of me asking for his experience. Thank goodness for that, as I later found out through new counsel that he had only been licensed for one year at that point. Furthermore, my case was not nearly as iron-clad as Mr. Rapacke would have had me believe. I'm writing this email nearly a year later because that's almost how long it took to settle the matter. If you are looking for someone to fill out and submit forms, I'm sure Mr. Rapacke is the man for the job. When it comes to advocacy, accuracy, communication, and aggression, however, you are better spending more money with a firm that has more experience or, at the very least, is willing to answer the question of how much experience they have instead of throwing a hissy fit when when asked about it. Mr. Rapacke gets 2 points solely for being a vet.

Did not do what I ask

Talked on the phone, never met only has a virtual office. Responded quickly till he got my money. Got application that was not professional a bunch of information that had nothing to do with my invention.. As soon as I questioned him he quit responding. Took his name off my application at the USPTO a...nd did not even give them my address or phone number. Was never told if he filed the app that I would not be on file other than by name only. Had to contact Patent office to make sure I did not miss any correspondence. I ask for things to be added to my patent that were not, and now cannot till I file the next patent application. Needs more experience than 10 months on how to treat clients. After he gets your money, he does what he wants to do with your application.

The client was advised of the patent prosecution timeline which laid out specific dates she could expect each aspect of the patent to be completed. All our original delivery dates were fulfilled on time as promised. The client asked us to change some of the wording in the patent application which pushed back the filling date back by one day. I fielded numerous questions about the patent wording, which is common for first time patent applicants to have, and I tried to explain why the patent included the information and references that were confusing to the client. We welcome phone calls and emails with questions and pride ourselves on timely responses but this client called and emailed multiple times over the weekend, then left angry messages on Monday morning before 9am because she had not yet received a response. Once filed, the client’s email and phone calls became increasing disrespectful and argumentative to my employees and myself and regrettably we had to part ways with the client. I stand on my record of 1000’s of successfully handled patent and I.P. matters as well as my previously flawless review record as proof of my commitment to provide passionate and meaningful intellectual property protection to every one of my clients.
