Seth Holliday is an attorney dedicated to representing the seriously injured or impaired in disability litigation. He has built his legal career on the principle of aggressively pursuing full and complete compensation for all his clients.
Seth is a 1996 graduate of Washington University School of Law and he initially practiced in Chicago, Illinois. There, in the personal injury context, he had a principal role in obtaining three awards which were confirmed by the local jury verdict reporter as being the highest on record in the State of Illinois in their respective category.
Seth is licensed in Georgia, Tennessee and Illinois and is an experienced litigator. Seth has practiced before both federal and state trial and appellate courts, including the 6th Federal Circuit Court, as well as the United States District Courts for the Eastern, Western and Middle Districts of Tennessee, Middle, Northern and Southern Districts of Georgia, Middle District of Florida, Eastern District of Kentucky, Western District of Pennsylvania, Northern District of Illinois, and District of Massachusetts at Boston. He has also taught trial advocacy at DePaul University College of Law in Chicago, Illinois, and business law at Chattanooga State Technical Community College in Tennessee.
As a partner at McMahan Law Firm, LLC, Seth primarily litigates disability, health and life insurance claims on behalf of individuals who have been wrongfully denied their benefits. With respect to private insurance benefits, Seth sues insurance companies like Unum, Hartford, Prudential, Standard, Guardian/Berkshire, CIGNA, MetLife, Aetna, Liberty Mutual, Mass Mutual, and others that have denied individuals their private disability insurance (called “Long-Term Disability” or “LTD”), life insurance or health insurance claims. His track record here is superb and he obtains excellent results for his clients. Seth is one of only a handful of attorneys across the U.S. that practices heavily in these areas.
In terms of Long-Term Disability or LTD cases, Seth handles 2 types of cases: (1) LTD cases governed by the Employee Retirement Income Security Act of 1974 or ERISA (where the disability insurance policy was bought through the employer) and (2) non-ERISA LTD cases (where the disability insurance policy was bought directly by the claimant such that the claim proceeds as a private disability claim governed by state breach of contract law). Seth handles these ERISA and non-ERISA claims on anation-widebasis and has had clients all over the U.S., including residents of California, New York, Massachusetts, Texas, Alaska and Hawaii.
With respect to Social Security Disability or SSD cases, Seth has represented well over a thousand claimants at Social Security hearings, has a very high success rate, and is certified as Specialist in Social Security Disability Law by the National Board of Social Security Disability Advocacy.
Seth is a highly competent attorney who has lectured regularly on disability issues to other attorneys. Some of the organizations Seth has spoken to include the American Association of Justice, the Tennessee Bar Association, the Tennessee Association for Justice, the National Business Institute, the Chattanooga Trial Lawyers Association, Chattanooga Cares, Chattanooga Inner City Ministries, the Arkansas Trial Lawyers Association, and the Kentucky Justice Association. He has also lectured on the topic of personal injury to the Illinois Trial Lawyers Association.
Seth is a leader in prominent organizations such as the American Association for Justice (AAJ), Tennessee Association of Justice (TAJ) and the Tennessee Bar Association (TBA). Seth is a member of TAJ’s Board of Governors, past-Chair of AAJ's Disability Law Section, past-Chair of TBA’s Disability Law Section and past-President of the Chattanooga Trial Lawyers Association (CTLA). AAJ, TAJ, TBA and CTLA are all associations of lawyers who advocate on behalf of injured or impaired individuals
Seth also provides free legal services to a variety of charitable organizations in the Chattanooga area, including several hours on a weekly basis to the Chattanooga Community Kitchen and several hours approximately bi-monthly to Legal Aid of East Tennessee. Seth is a two-time past recipient of the Pro Bono Excellence Award. Seth is also a member of the Board of Directors for Hospice of Chattanooga (and serves as current Chairman of its Governance Committee, a member of its Executive Committee, and has served as a former member of its Finance Committee).
