Expungement

We approached Mr Faucette for a possible early expungement in 2015 before the new NC expungement law passed in 2017. Beyond the consultation, we didn't hear much from him after we paid the fee, which was three times of that from another lawyer we used later on to file the expungement in 2017. I u...nderstand that it may have been more difficult before the law was passed, but what was concerning was that it was difficult to hear from him or get a straight answer after the fee was paid. If we did receive a response, it wasn't a concrete no, this can't be done, or yes, we can move forward either. It wasn't until the law passed and I reached out about it, that I received an almost immediate response and was quoted another fee to have it filed. We decided to go with another attorney and the record has since been expunged, and we have moved on. It was an expensive lesson learned.

Very unresponsive

I hired Mr. Faucette for a DWI with misdemeanor child abuse charges (because I had minors in the car at the time) that I had incurred last year. After talking to a few lawyers that seemed doubtful about my case, I felt better and more confident after my consultation with Mr. Faucette. One of the main... reasons why he was hired was because he stated that he "loved the Lord" and was willing to work with me on payments. Throughout this nearly year-long ordeal, he was very hard to get ahold of, and would often leave my texts unanswered. He would say he would call me at certain times, but would never call. He eventually was able to get the child abuse charges dropped and got a good, lenient judge who gave us what we asked, for which I am grateful; however, I was left with a bad taste in my mouth. He just seemed like he was unconcerned. In addition, I was let go from a new job because, although the child abuse charges were dropped, my employer Googled me and saw that I had those charges previously. I texted Mr. Faucette to ask his advice as to how I can go about getting this information taken down, and I have yet to receive a response (it's been over a month). Given my previous interactions with him, I don't think I am going to get. I think that Mr. Faucette is a very knowledgeable lawyer; however, I am dissatisfied with the overall service I received.

Similar to the review I received below on an old expungement case (where the client did not inform me that she had already received an expungement previously) this client did not leave her name on her review. Nevertheless, I can tell from this review exactly who left the comments. I will again explain that it is ALWAYS, ALWAYS, ALWAYS my goal to provide caring service and quality legal representation to every client, and when a client is not satisfied, I welcome the opportunity to address the client's concerns. As I am just reading this negative review for the first time on June 7, 2018, here are my thoughts: Last year, on May 20, 2017, this client posted her comments. This was after I helped her - for a reduced fee - avoid a possible 24 month jail sentence (she instead got alcohol abuse treatment and a few days in county jail) and avoid a possible $4000 fine (she only got a $200 fine, as I recall). Also, I recall having to pull some strings to get her case docketed early so she could move out of state. Could I have responded more quickly to her texts and emails over the course of my representation? Absolutely. I can always improve on my client correspondence. For that, I am sincerely sorry for any feelings she may have developed as to my level of care for her. I assure you, I prayed for her throughout the representation, AS I DO FOR ALL MY CLIENTS. After her posting, back in June 2017, this client reached out to me to ask about my filing an expungement for the child abuse cases that I was able to get DISMISSED for her. I immediately replied that I would be happy to assist her. She said she would get back to me when she had funds available to retain me. I have never heard back from her, but I will reach out to her again now that I know she posted this negative review last year before I replied to her expungement request. As I mentioned below, on the ONLY other negative review I have received in 16 years, as an attorney, and more importantly, as a Christian attorney, I try to do all my work for the glory of the Lord (Colossians 3:23). I am saddened to learn that there is a past client who obviously felt betrayed by my care of her and by my care of her legal matter. Again, I pledge to her, and to all future clients that I am honored to represent, to at all times offer my best service and representation for a fair and reasonable fee. May God bless you all!!!

don't hire him outside of criminal law

He lied to me. don't hire him for anything other than criminal law, I made that mistake and he gave my opponent free legal advice and helped him strike a better deal than what he was asking for. My opponent committed perjury but Faucett disregarded that entirely just to get rid of my case. A complete... waste of money.

Unsuccessful expungement

I hired and paid him to do an expungment. Of course the payment was received but the expungement was never processed. I attempted to call and email him for an update and the status but he gave me some run-around answer that was not consistent with the courts. He never refunded me the money I paid h...im to do the expungement as he stated he would.

Response from Attorney Matt Faucette: Given that the individual client who posted this review did not leave their name, I unfortunately cannot respond specifically to the client or to the underlying issue. That being said, because it is a fairly rare occurrence for my clients to be dissatisfied with my service and representation, I am close to certain that I can recall this incidence (from 7 years ago) and this client's name (which I will obviously not share for attorney/client confidentiality purposes). If I am recalling this client properly, she had retained me to represent her in a "possession of marijuana" case. I was able to get the case dismissed for her (as well as a companion case for her boyfriend). She then asked me to file an expunction for her. I did that. Unfortunately, under NC law at that time, an individual who had already filed for, and had already been granted, an expunction for a previously dismissed case, could not avail themselves of another expunction. She had apparently been charged with "harassing phone calls" in a different county in 2002 and she had requested for that charge to be expunged in 2004. When I interviewed her for the 2008 case, she did not remember filing that expunction and, as a result, she did not disclose to me that she had already used her expunction already. If she had, I would have advised that she would not be allowed another expunction, and I would not have done the work to seek another expunction. So, I drafted and filed all the expunction documentation, and when the request was finally denied, I advised her of the fact that she had previously filed for an expunction. Regarding this poster's allegation that I did not return her fee, I must admit that I do not recall returning any fee. I was hired to represent her in the misdemeanor drug case and was thankfully able to get the charges dismissed for her. I actually didn't charge her any additional fees to handle the expunction, so I did not return any fees. That being said, it is ALWAYS, ALWAYS, ALWAYS my goal to provide caring service and quality legal representation to every client, and when a client is not satisfied, I welcome the opportunity to address the client's concerns. If this poster ever reads my response, I would certainly welcome the opportunity to discuss any issues with her. (And if this poster is not the client I am herein describing, I welcome that phone call as well.) As an attorney, and more importantly, as a Christian attorney, I try to do all my work for the glory of the Lord (Colossians 3:23).
