Should be charged with legal malpractice

A lawyer has a duty in all dealings with a client to act with honesty, good faith, fairness, integrity and fidelity. I hired Mr. Jimison to file for a final divorce after he was referred to me. I should have let it go after trying to get hold of him for weeks. I finally met him in his office where th...ere was no one but himself. He was in shorts. I paid him $400 to file. When the divorce was contested he asked for a retainer fee of $2,500. From that time on, the only time I would hear from Mr. Jimison was when he needed money. He would NEVER return a phone call, his email had automatic response that he was in court which seems to be all the time. Not one time did he give me any update on what was going on with the case. Then one day Mr. Jimison called and asked me to meet him urgently in his office (this was after I had finished paying the retainer fees). Mr. Jimison told me that we had a court appointment the next day. When I asked him why we were going to court, he told me that he didn't know. No kidding! Up to this point I had not seen a single document of communication between Mr. Jimison and the defendant's Attorney. We I showed up in court Mr. Jimison came to me with a proposal from the defendant attorney to settle the case. I was in utter shock because I was completely unaware that this is why we came to court. Mr. Jimison apparently knew exactly what was going on but didn't tell me. He came to me and said " I will kill you if you don't accept this offer". Again, I was in utter shock. Apparently Mr. Jimison later submitted a non modifiable settlement to court, signed it without my approval or review and NEVER even sent me a copy of the settlement. I never even received a copy of the settlement after Mr. Jimison had received a copy from the court. It was only after I had received another letter to appear in court that I found a copy of the document in my mailbox (without postage stamp) . I had to appear in court to defend myself on a judgment that I had not even received the draft or final documents from my Attorney. The court judge laughed at me when I told him I had not seen any documents and proceeded to slap me with the defendant's attorney's fees. Despite numerous phone calls and emails, I never had from Mr. Jimison. It became apparent to me earlier in the case that Mr. Jimison appeared to have a lot of issues going on especially personal including finances that he occasionally complained about. It never occurred to me that the level of negligence and incompetence would run so deep. Apparently he did absolutely nothing with my case until he must have received a letter for us to appear in court. At that point he had no choice but to get me to agree to some settlement to save his neck. He even went further to sign the final documents and submitted them to court without my approval. I have since been bound for the next 10 years by court documents that I never even had a chance to approve. To think that an individual who was supposed to represent me in good faith would do this to me has been devastating. The sad thing is that there seems to be nothing that I can do about it. it's a shocking true experience. It is a shame that Mr. Jimison may still be out there doing this kind of stuff to other clients. Someone once said that given a choice between being innocent and having a good lawyer, you're better off with a good lawyer. This guy is definitely not someone you want n your corner under any situation. Shame on him for what he did to me.

Totally professional and effective.

Shane obtained my divorce within 30 days, totally knowledgable, and prompt. I have recommended him to at least two people. You will not be disappointed.

Awesome Experience

I had worked with a lawyer in the past and was not impressed. Browsing online one day I came across Shane and decided to give him a try. Couldn't ask for a better experience its been a pleasure working with him. I would recommend Shane to anyone who wants to have an easygoing and as much of an enj...oyable process as you could have going through a divorce, or whatever matter you may have.

Do not use this guy

This guy is very hard to get into contact with. He assured me my uncontested divorce would be finalized in eight weeks, its been a YEAR later. I think I would have faired better filing my own divorce.

RUN. And ask a lawyer you trust for a referral.

Shane is everything a lawyer should not be. No paralegal or support staff make getting return calls nearly impossible. He doesn't check his mail very often, which is a problem when the courts communicate almost exclusively through mail. He misses court dates, ignores voice mails, and worst of all, he... doesn't have the ability to say, "This is over my head, we need to get you in touch with a specialist in this area". instead he continued to take my money and my time while doing no research or due diligence. Opposing counsel preyed on his inexperience and lack of attention to detail. This lawyer has cost me, literally THOUSANDS of dollars in legal fees and left such a mess that it has caused me to hire an expert to try to untangle a mess. In the meantime, I am still tied to my ex-wife financially and lucky to not be bankrupt. Worst of all, Shane just doesn't care if this is your life. He's too busy taking every Friday off (he doesn't tell you that, by the way) and taking vacations and just being unavailable. The problems he caused are serious enough to warrant a malpractice suit, which I am pursuing. You may think you're getting a deal, but he cost me three times what it would have cost to hire a decent and experienced attorney like the one I have now. Do yourself a favor and don't waste time. If a lawyer doesn't have someone to even answer the phone, let alone return a call or file a piece of paper for you, he's not going to be able to practice law while running his office at the same time. And let me tell you, practicing law was pretty far down on his list of important things to do. RUN. DO NOT WALK. Shane may be great in traffic court, but anything that involves complexity or legal nuance should not be handled by him.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
