We are an estate planning and general practice on the outskirts of Charlottesville, Virginia. My wife, Lelia, and I are both lawyers with years of experience in complex multi-district litigation. We are both former Assistant Attorneys General.
In our estate planning practice, our main goals are to keep your loved ones out of conflict and out of court. Because we are a blended family with children, and because we have a child with special needs, we are keenly focused on families like ours, and we know what to do to make sure that your children are protected and well cared-for in your absence.
I have been practicing since 1984, with the bulk of that time either at the Texas Office of the Attorney General, or in my own national, multi-district litigation practice. My wife joined me at Winget-Hernandez, P.C. in July of 2013, after working for 7 years as an Assistant Attorney General for Virginia.
After years of public service, and many years of representing states and other public entities, we started this practice to help people. We are here to serve you, the people of our community who have problems that seem to need a legal solution. We can tell you whether the law provides an answer for you, and if it does, we can find it for you. If you are an employee or a business owner with a legal question or issue, or if your legal matter is simply a personal one, call us. If the law can help you, we will. If it can't, we will let you know right up front.

Surpassed my expectations
Michael referred me previously to several local specialists. After weeks of being run around I contacted Michael with 1 day left to file a response and default judgement would have been awarded. He quickly got the response in and worked with opposing council to reach an amendable solution. Michael sa...

Surpassed all expectations!
Received my first ever speeding ticket. I had made plans to go to court to both acknowledge my role in the ticket but also to ask for consideration due to my numerous years of unblemished driving. Fortunately, I received a letter from Mr. Winget-Hernandez offering a 30 minute f-r-e-e consultation. ...

Honest straight forward and genuinely wants to help
He gave me a free consultation in regards to a pending lawsuit against me from a student loan debt collector. He laid out all the steps I needed to take and while he was willing to take the case due to travel time it would have been restrictive. He referred me to several specialists in my area and ga...
"Michael is intelligent, patient (very patient), savvy, hard-working, fair and honest. As an attorney myself, having worked in a large, international corporate law firm, I know it is quite rare to find any of these characteristics, let alone this combination of them, in a single attorney."
"Over the years I have worked with Michael on numerous complex litigation matters and have always found him to be competent, hardworking and highly motivated."
