I tried this Ten Commandments Case, an Establishment Clause case in which the Ten Commandments Monument on the Grounds of the Texas Capitol was challenged as reflecting an unconstitutional establishmen ... t of religion, in violation of the First Amendment. I represented the State of Texas defendants, which included the Governor, the President of the Senate, the Speaker of the House of Representatives, and the State Preservation Board and its members. I wrote the brief to the 5th Circuit, which formed the basis of the brief to the Supreme Court. I was a co-author of the brief to the Supreme Court. The case was argued in the Supreme Court by the Attorney General.
