Gary and Robert explained it to me and I understand it now. I was charged with my 3rd dui and unfortunately it was bad. (I finished my 28 day Inpatient program Robert found for me and Gary’s old client Marc has been my AA sponsor for 4 months!) Anyway, Gary got discovery from the district attorney an...d it said there was video. Gary requested the video which never came. They sent a letter to the judge telling him to order the video. On the court date the judge rescheduled my case but told the district attorney they had to give my lawyers the video. So, yesterday we had our court date and the district attorney said there was no video. So Brady violation means that the district attorney has to turn over anything that shows my innocence. I remember that the the other driver came into my lane. And Gary told the judge that the video existed but that the district attorney saying he couldn’t find it wasn’t good enough because Gary didn’t have the opportunity to try and track the video down himself. The police report said there was video. It was just lost. Gary has had this happen before and was able to get it before. The judge said that the district attorney couldn’t use any evidence that the video would show. I had my trial and Gary kept objecting. I won when the district attorney finished her case.
