Absolutely Awful! Lost me over $100K on a settlement

First off, the communication for everything related to my case was always last minute, I was rarely looped in, and his office failed to file a lis pendent on the title for a deal that had gotten tied up but for which I had a legal residential purchase agreement. As a result, the house was sold to an...other buyer but not without dispute- obviously this cost an excessively higher amount of money to pursue than the lis pendent, which would have prevented this problem from the beginning. Flash forward, the lead lawyer on the case is confident and excited that we can recover the $175K in damages that we suffered from losing the purchase agreement and a confirmed assignment of the contract for the property in question. Worst case scenario, he projects a $130K settlement. Not $175K and would have to cover the lawyer fees, but I'll take it. The lead attorney, "last minute" will not be able to attend the settlement hearing because his wife had a baby- not sure how this took anyone by surprise and another lawyer was not ready to proceed, but okay. I am assured that the lawyer filling in has been briefed and is prepared. This couldn't have been further from the truth. I was completely blindsided by having an attorney at the only settlement hearing that I have ever been experienced, was completely railroaded by the mediating judge, who immediately rejected the $130K asking price in the settlement and dropped it to $62K, which was based significantly around the false information that the "fill-in" lawyer presented the judge regarding the attorney fees. He stated that these fees were $25K. They turned out to be over $48K. The attorney was not familiar with the most basic elements of the case- couldn't even tell the judge whether or not their office ever filed a lis pendent on the property, didn't know about the assignment contract, didn't know key dates, and could not inform as to how the joint venture agreement would factor into the settlement such as whether or not the joint venture partner had a claim to the settlement funds, which was another obvious significant factor. I made it abundantly clear during the settlement proceedings that I was not okay with settling for anything that would not meet a personal net profit of $27K on this deal, which was already less than a third of what this contract should have netted had the assignment taken place. Instead, this fill-in lawyer sat silently, didn't speak up for anything to protect my interest in the settlement, provided wrong information (the lawyer fees ended up being $48K), and in the end, I went from the minimum of a $130K settlement that the lead lawyer had projected to a personal net profit of $7K, while the law firm walked with over $48K. One word comes to mind when I think of this experience- criminal. I feel scammed and cheated out of the work that I did, which included over 4 years of communication, helping clean out the home in question free of charge, and more to solidify this contract. The settlement doesn't even cover the hours that I spent to secure the contract. I would most certainly not recommend Brian nor his office to represent you. There was nothing professional and definitely not competent in my experience.

While I was not directly involved in this case, unfortunately Mr. David suffers from the proverbial "buyer's remorse" after agreeing to a settlement with full knowledge of its terms. He misrepresents the facts above and unfairly slanders two attorneys in the firm. I hesitate to even respond with this post, but fear silence will be deemed acquiescence.

Not even the courtesy of a brief response after a month!

A month ago I emailed Mr. Gormley through the AVVO message system and received a notice that the message had been sent. I asked only three brief and basic questions about his practice, each of which could be answered briefly and quickly, taking probably less than 15 seconds total., and included my c...ell number and email address. Nevertheless, over a month later, I have received not even the courtesy of a brief response.

Legal service poor

I had Brian write a will for my husband. My previous attorney who had assisted us with a plan for long-term health care expenses advised me to put a clause in the will which I asked Brian to include. My husband was in rehab and I didn’t take the time to review the will as I should have. Becaus...e Brian did not include it I was open to a lawsuit. My litigation lawyer even commented on the Will Michelle his partner was supposed to handle my probate but was extremely unresponsive and inaccurate. These two are NOT detail oriented. I suspect they take on more cases then they can actually handle to increase their incomes.
