While Mr. West did not handle settlement of my late husband's estate, he was consulted and retained to assist resolving distribution of assets where an ex-spouse was beneficiary on an IRA account . The former spouse had, as part of a divorce settlement decree, relinquished all rights to any assets an...d this agreement was in writing. Even with this documentation, the financial institution would not distribute the assets to the estate without a release from the former spouse or a court order directing them to do so.
