Jason Zuckerman represents employees in a wide variety of workplace-related disputes, including whistleblower retaliation, harassment, qui tam, wrongful discharge, discrimination, non-compete, and other employment-related claims.  His broad experience includes practicing employment law at a national law firm, serving as a Principal at The Employment Law Group, and serving as Senior Legal Advisor to the Special Counsel at the U.S. Office of Special Counsel, the federal agency charged with protecting whistleblowers in the federal government. In 2012, the Secretary of Labor appointed Zuckerman to serve on the Whistleblower Protection Advisory Committee, which makes recommendations to the Secretary of Labor to improve OSHA’s administration of federal whistleblower protections.

Zuckerman co-authored a chapter on litigating whistleblower cases for Whistleblowing: The Law of Retaliatory Discharge, drafted a chapter on the D.C. Whistleblower Protection Act for the D.C. Practice Manual, and is a contributing author of International Handbook on Whistleblowing Research. For nearly a decade, Zuckerman has been a contributing author to an annual update on the whistleblower protection provisions of the Sarbanes-Oxley Act published by the ABA Fair Labor Standards Legislation Committee. Zuckerman’s articles have been cited in various treatises and in a federal court opinion on the scope of Sarbanes-Oxley whistleblower protection. Zuckerman has trained administrative law judges, agency EEO directors, senior OIG officials and delegations from more than 30 countries on federal whistleblower protections.

In addition to shaping whistleblower protection law through successful outcomes for clients, Zuckerman has worked with whistleblower advocates to draft and lobby for passage of whistleblower protection laws, and advocate for more effective and vigorous enforcement of whistleblower protection laws. Zuckerman drafted portions of the 2009 amendments to the D.C. Whistleblower Protection Act, which is now the strongest public sector whistleblower protection statute at the state level, and testified at a hearing about those amendments. Zuckerman’s recommendations for improving OSHA’s Whistleblower Protection Program are cited in Congressional hearing testimony and a top-to-bottom review of the program, and comments that he co-authored are cited in final regulations implementing the whistleblower protection provisions of the Energy Reorganization Act and six environmental statutes. He also led a coalition of whistleblower advocates in meetings with the SEC Chairman, two other Commissioners and senior SEC staff to offer the whistleblower perspective on proposed regulations implementing the whistleblower reward provision of the Dodd-Frank Act. Zuckerman has drafted amicus curiae briefs in leading whistleblower retaliation cases, including Powers v. Union Pacific Railroad, Johnson v. Siemens, Bonds v. Leavitt, and Welch v. Chao, and his advice on whistleblower protections is cited in Financial Statement Fraud: Prevention and Detection and Nonprofit Financial Management: A Practical Guide.

Zuckerman serves as Co-Chair of the Whistleblower Subcommittee of the ABA Labor and Employment Section’s Employee Rights and Responsibilities Committee and served as Co-Chair of the National Employment Lawyers Association’s Whistleblower Committee, Co-Chair of the Sarbanes-Oxley Subcommittee of the ABA Labor and Employment Fair Labor Standards Legislation Committee, Co-Chair of the Whistleblower Committee of the District of Columbia Bar’s Labor and Employment Section, and member of Law 360’s Employment Editorial Advisory Board.

Zuckerman graduated Phi Beta Kappa and magna cum laude from Georgetown University and received his law degree from the University of Virginia, where he served as Articles Editor of the Virginia Journal of Law and Technology. In law school, he received the University of Virginia School of Law’s Pro Bono Award for his advocacy on behalf of prison inmates and mentally disabled individuals and helped establish a successful pro bono program that encourages students to volunteer a minimum of 150 hours of pro bono service during law school.

phenomenal
I hired Mr Zuckerman to pursue an action against a former employer that was attempting to use deceit in its pursuit of federal contracts, and which fired me for not participating in its schemes. Jason was not just very responsive, he was also engaging, spending a good deal of time and effort with me on the phone and by email learning the ins and outs of the case, discussing strategy, laying out alternatives, anticipating counter-arguments, etc, all with the highest integrity. In the end, Jason was able to negotiate a substantial settlement for me, and I believe the company learned not to fire employees for failing to participate in lying to the government. All in all, a very good outcome. I have had the opportunity in my career to interact with numerous attorneys. Jason truly stands out. I wholeheartedly recommend him to anyone seeking a lawyer for wrongful termination and related employment issues.

Simply the best
Thank the Lord I found Jason Zuckerman. I was in a bad situation; I was put on leave from my company after reporting to the Board of Directors that the CEO asked me to make some questionable accounting entries (I was the CFO). The company took the CEO's side and I was left out in the cold by trying to do the right thing. I was left hanging on leave and being interviewed by a company hired investigator. I found Jason and he immediately put me at ease and took over. All of a sudden the company was on the defensive and I was on the offensive. It was over in two weeks. Jason was there for me the whole way and was sincerely interested in me as a human being as opposed to just a contingency fee. Like I said, simply the best.

Top-Tier EEO Attorney with Human Touch
As a finance exec, I have spent my career working closely with hundreds of lawyers. On balance, Mr. Zuckerman is the best lawyer I have ever encountered. Although he runs a small law firm, I watched as he ran circles around multiple lawyers both in-house and at a large, nationally-recognized firm. Although the evidence in this matter was compelling, the other side did not have the self-awareness to understand what that meant, making for an almost impossible negotiation. Each time I was convinced we hit the final road block, Mr. Zuckerman would pull a rabbit out of his hat to progress the negotiation. He was responsive, available 24/7, and operated not only as a world class attorney, but as an "ad-hoc therapist" in what is necessarily a stressful process. He is the only lawyer I've ever encountered that not only has the tools to go up against the largest law firms in the nation, but also truly cares about his client, and will do the right thing to defend his client at all costs. He routinely makes decisions and provides counsel that is in best interest of his client, regardless of whether it hurts his bottom line - in fact, he agreed to forgive much of the costs on the defense side despite the fact that he took a significant haircut on the overall negotiation. He truly believes in the cause of protecting employees against predatory employers, and it shows in everything he does.

National Defense Authorization Act (NDAA) and Whistleblower Retaliation
I was in a very difficult work situation dealing with the National Defense Authorization Act (NDAA) and whistleblower claims, and I needed legal representation. I was referred to Mr. Zuckerman by an attorney for a major corporation, who indicated that if they were in a similar situation, they would want Mr. Zuckerman on their side. From the get-go, Mr. Zuckerman listened to the details of my situation and believed in the merits of my case. He quickly dug into the details of my case and asked me thought-provoking questions, providing his legal expertise to help to build and shape my case. In doing so, he led me to see clearly how the employer wronged me. With his probing questions and knowledge of the relevant and applicable laws/statues, we filed a very strong NDAA and whistleblower claim, and combined with his tenacity, I was eventually able to settle with my employer and avoid a lengthy lawsuit. Mr. Zuckerman was very knowledgeable, professional, and always in my corner. He was always accessible, and always very responsive to my questions and needs. He accompanied me and represented me in official meetings, and he was always available to provide guidance, even emailing and responding to me very late in the evening. Without a doubt, the very best pro-employee attorney that you will find.
After an employee leaves a company, (due to termination, layoff, restructuring, plant closing), they often are presented with a separation agreement that requires the employee to give up many important legal rights in exchange for receiving a small amount of severance pay and benefits. My former employer, a large Fortune 500 company, did just that. Many of my colleagues just signed it. I too was tempted to sign it, just to get it over with. I really needed the money to pay rent and bills but I wasn't comfortable with accepting what appeared to be "hush" money after what I had experienced at the company. I searched online for an attorney who specializes in this area of law - employment separation agreements, and I found Jason Zuckerman. Jason, and his colleague Dallas, were very patient with me and took the time to review the documents, explain the law and explain my legal rights and my options in great detail. They determined that overall the agreement was very employer-biased and some parts were over-reaching, unethical, potentially illegal, and that signing it could create big problems for me if I continued to work in the same line of business or for a competitor; which is what I planned to do. Some companies will go to great lengths to silence employees, and former employees, if the company is likely to be sued or become the subject of a government investigation. Please do not be intimated, and do not sign and run, as doing so may come back to haunt you in the future if/when you are called to testify in an investigation or court case. At first, I thought I could negotiate the agreement directly with the company, but it was like David and Goliath. It was a huge relief to hand it off to Jason and Dallas to deal with the company's attorneys so that I could focus attention on my job search. Jason and/or Dallas contacted me every week with an update and the next steps. I've dealt with other attorneys in the past and often felt left in the dark for weeks and months with no update. Jason and Dallas appear to work non-stop. We often talked on weekends if they were in court all week. The important thing is that I always knew where I stood and it relieved a lot of stress. I have no regrets about hiring Jason and Dallas and I recommend them without any reservations. I was very happy with the entire process and I'm very happy with the end results; especially the peace of mind knowing that I signed a fair agreement written by attorneys representing me and my interests. I sincerely hope you don't, but if you lose your job and you have concerns about signing one of these agreements, I strongly urge you take a deep breath and contact Jason before you sign anything.

Honest and Professional
Mr. Zuckerman is head and shoulders the best employment attorney you will find. He took my initial call at 9 p.m. on a Friday (when I would have thought an answering service would be taking his calls.) but no he answerwed and spent an hour with me on that first call, who does that? He was honest about the likely outcome, even if it's not what you want to hear, but it's what you "need" to hear. He is going to set the proper expectations, and fight for your best interest thruout the process. This is a very complicated field (employment law) where everything isn't as simple as it might seem. He will guide you on how to best approach the landscape. I highly recommend Jason and his team, and would suggest you call him as soon as you have employment concerns, to give you the best protection possible.

Wrongful termination- SOX retaliation
Jason Zuckerman was able to work with the facts of my case, to correspond with my employer, and ultimately negotiate a settlement that was substantially greater than the original severance offer. This ultimately allowed both parties to avoid the risk and protracted delay of a lawsuit and to move forward. While it is impossible to know, circumstances indicate that our actions and clear communications also resulted in the company taking further actions to address the underlying circumstances of their retaliation. Jason was fair, firm, clear and thorough throughout every turn. This ultimately convinced a very large firm on the defendant's side to settle for a fair amount.

Truly amazing experience
When I sought out a DC-based attorney to represent me, I expected a competent attorney who would get me through my sexual harassment lawsuit. Extraordinary and dedicated
I am a whistleblower for the US Government, and suffered continued harassment from my superiors. After Jason came on board, he never let up until they left me alone. He was dedicated, caring, and he nailed my agency with everything he could find. (He found a lot!) He quite simply cowed them with his superior knowledge of the law. Simply the best
After searching and interviewing several firms specializing in labor laws for a year; I was lucky enough to be referred to Mr. Zuckerman. There are many lawyer in Washington DC area; however, finding a professional who is great at his practice and actually cares about his clients is hard. He is a caring professional that strategizes from the outset to ensure the best possible outcome for his client. Provides confidence and assurance; professional and smart
I come from a family of lawyers and many of my friends are attorneys, too. As highly as I think of them, they fade in comparison to Jason. He is everything the other reviews say and more. He takes pride in his practice and makes you feel like you are his only client - even though I know he is very busy and in high demand. He never pressured or rushed me to make any decisions. He explained the pros and cons thoroughly and made sure that I clearly understood everything before we would move forward. At a time when my employer was against me and my "friends" turned their backs on me, Jason's solid legal advice was an anchor, providing calm and reassurance even while not truly knowing the outcome or being able to guarantee results. It felt like we were a team and in sync. He helped me achieve results that were great for me individually. With him in my corner, I knew I was protected and that was a great deal to me and my family as we weathered the storm. I highly recommend him.
