She's a waste of time - poor knowledge of most recent immigration policies and doesn't honor time contracts

I scheduled and paid Tejal's office for a 30 mins consultation session to learn about immigration options for my situation. I was scheduled for a 12noon meeting, but was later told to call her at 12:10pm, which I did expecting to be there for at least 30mins. Long story short, Tejal ended our chat at... 12:29pm so she could get to her next meeting with zero apologies or remorse for messing up my schedule Worst of it all, she had no recent idea for how my situation was handled by USCIS. She said her most recent knowledge of such situation was from 4 years ago - BEFORE THE TRUMP ADMINISTRATION(!!). She then went on to ask me to pay her $500 to research my question - I honestly felt insulted. I'm extremely disappointed and feel like I wasted my money booking a consultation with her office.

Dear Mr. A****: I am sorry to learn that you were disappointed with your experience consulting with us. However, I am surprised to read many of the statements you make in your review. As an initial matter, please remember that the reason the starting time of the consultation was delayed is your not making an advance payment of the consultation fee as requested. Nevertheless, upon further reflection, I acknowledge that I should have suggested rescheduling your appointment due to the next booked appointment. Thus, I have refunded to you (via paypal) a prorated amount of the fee for the 10 minutes we had to spend to process your payment. Secondly, as a general matter, initial consults cannot provide solutions to complicated immigration situations. The research fee I quoted you is commensurate with the additional time I would spend to review applicable regulations and recent policy memoranda in the context of your complex immigration history. This is what responsible attorneys do when asked to provide a legal opinion in an unusual scenario. Please also note that an attorney cannot magically provide you with the remedy you are seeking if it does not exist. Third, your characterization of our conversation is incorrect. In response to your question inquiring if you can obtain an H1B visa through a change of status without going through consular processing, I mentioned that another client in similar circumstances with a B2 visa was able to do so, but that I did not have recent personal experience with this scenario. I noted that your situation was more complicated due to your pending B2 visa extension and my view was that it was likely that you would have to take the consular processing route unless your extension request was approved. When you pressed me to provide you with a path to avoid having to visit a consulate, I told you that I did not believe this option was available to you without a current B2 visa, but I could research your question further for an additional fee. To help you better understand the USCIS H1B and Change of Status adjudication process, I encourage you to review the guidance within the USCIS Policy Manual at https://www.uscis.gov/sites/default/files/document/policy-manual-afm/afm30-external.pdf https://www.uscis.gov/sites/default/files/document/policy-manual-afm/afm31-external.pdf Please pay particular attention to the numerous appearances of the statement, “Change of status applications are discretionary in nature.” This guidance indicates that it is ultimately a case-by-case adjudication. I wish you well in your endeavors. - Tejal Mehta, Esq.

Unsatisfactory experience

Reading a lot of reviews on Avvo and Google I got quite optimistic reaching out to Tejal so I booked an appointment as I wanted to seek immigration consultation. Unlike my expectation my experience was quite awful, distressing and confusing. Tejal contrary to what I was expecting was not very sure of... questions being asked, provided contradictory statements and was not conclusive at all. I wouldn't recommend anyone seeking immigration help to come here as my session was not at all conclusive and rather I felt I wasted my time and money.

Dear Hitesh, Thanks for consulting with us after thoroughly analyzing our online reviews. We are sorry to hear that you are dissatisfied with your consultation. We take each of our initial consults seriously and endeavor to provide the best advice possible given our understanding of your situation. My feedback to your questions was based on the applicable regulations and policy memoranda. Unfortunately, providing conclusive guidance as to how you should proceed would be misleading because there are several variables which you cannot control. We cannot predict a definitive outcome in your situation. Also, because our communication styles may be mismatched, I invite you to send me your questions in writing. I will then provide you with a written response that may offer you better clarity on your available options. Please call or email me to discuss this matter further. Best wishes, Tejal Mehta, Esq.
