Mistrial. Prosecutor withdrew all rape and related offenders
the trial judge as well as the Superior Court agreed with my motion to suppress that the police violated my clients constitutional rights and suppressed the evidence from use at trial and now there is no evidence left against my client.
Court suppressed the evidence and found that the police violated clients constitutional rights. The DA appealed and after arguing to both the Superior and Supreme Courts Mr. Acosta's case was completely dismissed and he served not one day in jail.
Court suppressed the evidence(firearms) as the warrant to search the home was illegally obtained.
Prosecutor conceeded the consent to the chemical test in a felony DUI case was illegally obtained after litigation of the motion before the trial judge.
Prosecutor reviewed motion to suppress over TEN POUNDS OF DRUGS and agreed the felony distribution charge should be dismissed and only a traffic ticket would be issued.
