The Superior Court affirmed the trial court’s determination in favor of TD Bank and found no ECOA violation. Accordingly, TD Bank’s entered judgment of $170562.83 remained in full force and effect against Ralph Papa and Linda Papa, jointly and severally.
The Breakers Beach and Boardwalk Resort L.P. v. Michael Rosen, No. 07-12068.
During a bench trial, Judge Jacqueline Cody found Rosen liable under the contracts for his $1.5 million obligation to Breakers Beach, plus all accrued interest and attorney fees. Cody rejected Rosen's architectural fee and misappropriation claims.
