Foreclosure 20%

In most cases, people facing foreclosure also have other debt problems. Therefore, as a general rule, we recommend that clients file for Chapter 13 bankruptcy relief. This gives the client up to five years to catch up on delinquent mortgage payments. It also gives them an opportunity to apply for a loan modification without the stress of a foreclosure action or the accrual of unnecessary court costs and legal fees. In appropriate cases, we can defend the foreclosure action without bankruptcy.

The most incompetent attorney ever.

My wife and I hired mr. Grubea to handle her bankruptcy case. we initially got a phone call from his secretary to set up an appointment to have a telephone consultation with mr. Grubea. he did call on time took a quick overview of our case and we decided to hire him and he wanted a $300 retainer in t...he form of a money order. We went and obtained the $300 retainer and mailed it to him, which his office promptly lost. after searching for it for almost a month they claimed they couldn't find it so we sent him out another $600 money order this time certified with return receipt. This money order was cashed. I should State for the record that the first money order was never cashed, they just lost it. For the next year, his secretary lost paperwork many many times. my wife faxed in and emailed then every documentation that he requested. All tax info, all employment info in the form of pay stubs, they even asked for my daughter who does not live at home with me pay stubs. his secretary said they never received it even though a read receipt was put on the emails so we know they were opened. after almost a year this back-and-forth we have still yet to speak to mr. Grubea. We dealt almost exclusively with his secretary. the last time I called and I tried to speak with mr. Grubea I was told again we didn't have paperwork and he was not available. at this point I told them it is been a year all I want to do is speak with my attorney that I hired I have never spoke with yet. then they decided I am too demanding and decided to drop us as clients and took two weeks to return our money. my wife gave oral and written permission for me to speak on her behalf to the attorneys on her case. I don't think it was unreasonable to ask to speak to the attorney that I hired and not just his secretary. I also don't think it was unreasonable to ask for a sit-down with the attorney that I hired. I was willing to travel from Rochester to Buffalo to do this. the receptionist that I spoke with besides his secretary told me that I accused them of stealing my money. I informed her that I never said the such I just wanted to meet with the attorney that I hired. Again, I don't think it was unreasonable to ask to speak with the attorney that I had on retainer. So in conclusion, I would NOT recommend mr. Grubea services to anyone unless you want to get run around and have to deal with his secretary for a year. And then if you dare to speak up and ask to speak with the attorney that you hired he will drop you as a client quickly. I am positive he will be on here to defend himself. no matter what he says I would not believe it. In my opinion, he may be a very competent attorney but his staff is terrible.

Very poor guidance.

You will never get to speak to Mr. Grubea about issues regarding poor handling of your case, only to one of his staff that you never met. At the end of my bankruptcy I had to keep calling the office to get them to finalize the bankruptcy by sending a simple form out regarding child support I do not o...we, which from what I understand is a formal document required to end all bankruptcies. That took a long time to get done after several phone calls to office staff. After working to establish credit I purchased a new car and think things are going well. Then I receive a bill 8 months after my bankruptcy was finalized for over $78,000 with over $19,000 in interest! After my bankruptcy is finalized and I get this bill from someone I never heard of a lawyer I never met told me he explained student loans can not be discharged in bankruptcy (and in certain circumstance they can Mr. Grubea). I was told when I filed bankruptcy my student loans were dischargeable due to them being sold twice to private lenders and my being offered a $5000.00 loan many years after I graduated to use on anything I wanted not related to educational purposes. I was able to have my student loan discharged during my bankruptcy under the student loan forgiveness program but since it was (supposedly) discharged in bankruptcy I did not qualify. The attorney I dealt with is no longer with the firm and another lawyer I never met tried telling me this was discussed when I filed, it was not. I would have never filed bankruptcy if this wasn't included or at least would have made payments to not get a surprise like this! Now after bankruptcy I owe $20,000.00 more than when I filed. When I tried to rectify this with Mr. Grubea's office I was basically told to pound salt and just pay the bill. Now I have to hire a real lawyer to rectify this. Consultation, advise, and assistance post-discharge is too poor to risk having something like this happen to you. I am by no means rich and can not afford this unforeseen bill. I REPEAT, I WAS NEVER TOLD THIS WAS NOT DISCHARGED, IN FACT I WAS LEAD TO BELIEVE IT WAS. I WAS TOLD "ALL" MY DEBTS WERE CLEARED. DO NOT HIRE THIS FIRM!

Highly recommend this bankruptcy lawyer ...

My case was not an easy one, having survived a bout with cancer and several business setbacks, as well as a prior bankruptcy under the old bankruptcy law, a lawsuit, and potential adversary proceedings (where creditors sue the debtor in bankruptcy court to have the debt deemed non-dischargeable). ...I consulted two other lawyers and one didn’t have the knowledge to answer my questions and the other moved too slow and wanted way too much money even to open the file (my car was in repossession mode!). Peter Grubea’s office handled and are still handling all these matters with expertise, courtesy and empathy. Bankruptcy law is way too complex for a general practitioner and requires a specialist, and Peter Grubea is one of the most knowledgeable bankruptcy lawyers in New York. His office staff is responsive and polite and his fees are very reasonable considering the time and number of court appearances my case required. I highly recommend his firm for bankruptcy and debtor-creditor problems.

Thank you for the positive comment. . Although we receive many emails thanking us, it is rare to have a client publicly express gratitude. This is because most people do not really want to advertise the fact that they have filed bankruptcy.
