Replied last August 20, 2019I understand that you would prefer a larger reduction. As your lawyer, I want nothing more than the most favorable outcome possible and I always work hard to secure that ideal outcome. Often, I do negotiate zero point resolutions but for the reasons discussed below that is not always possible. In New York, no person is entitled to a reduction and prosecutors ultimately determine the level of each reduction offer. Offers are based on the prosecutor's policy - which varies in the 62 counties in the state- the facts of each case, and the judge’s position on accepting the reduction. A county may have a policy to never offer zero points on speeding tickets, and several counties do. A clean record, among other factors, might warrant the best offer a prosecutor is willing to make, e.g., an offer of a 2-point non-speeding ticket to satisfy a 4-point speeding ticket. A bad record, on the other hand, could prevent an offer all together. It appears that you are more upset with the prosecutor’s decision rather than my services. But whatever the case may be, I welcome your call to discuss this matter further. Thank you.
