Daniel Michael Austin

Dan is a Partner in the Real Estate Practice Group where he represents buyers, sellers, developers, and lending institutions in all aspects of commercial real estate. He counsels a variety of local, national, and international clients including individuals, corporations, private equity and investment funds, as well as not-for-profit organizations regarding the development, sale, and leasing of commercial real property. Included within his practice, Mr. Austin handles leasing transactions on behalf of commercial landlords and tenants.

In addition to his transactional work, Mr. Austin also represents clients in several areas of real property litigation including commercial and private lenders in all facets of commercial foreclosures and workouts. Among his litigation clients, Mr. Austin handles quiet title actions, boundary line encroachments, right of way disputes, partition actions, adverse possession claims, and landlord-tenant disputes.

Mr. Austin has substantial experience counseling individuals and corporate clients in tax-deferred 1031 exchanges of real property, 480-a Forest Tax Law, and has represented clients in front of local industrial development agencies (IDA). Dan also represents property owners involved with oil and natural gas leasing, cell tower leasing, solar ground leasing, and wind turbine leasing.

Dan has assisted a variety of business owners with their real estate needs including investors and owners of apartment complexes, shopping centers, restaurants, gas stations, and liquor stores.

Mr. Austin has been selected to the Upstate New York Super Lawyers Rising Stars List for 2019. Only 2.5% of attorneys in Upstate New York are selected for this honor. Dan is a member of both the Onondaga County and New York State Bar Association, as well as a member of the Real Property Section of the New York State Bar Association.
