Joseph Benjamin Weiner

Joseph B. Weiner is counsel in the Litigation Group, focusing on complex commercial litigation matters.

Joe's practice focuses on complex commercial litigation in state and federal courts, and in arbitrations. He has substantial experience litigating commercial disputes involving contract breaches, business torts, real estate, tax, and intellectual property.

Recent examples of Joe’s practice include:

• Represented client through trial in New York State Supreme Court, Commercial Division, in action involving claims for fraud, breach of contract, and breach of fiduciary duties, relating to multi-million dollar investments in New York commercial buildings.

• Represent industry-leading media company in several breach of contract disputes in federal and state courts.

• Represent Belizean corporation in arbitration involving international chemical supply contract, with a three-day virtual arbitration hearing.

• Represent corporate clients in a variety of disputes arising out of COVID-19, including commercial and ground lease breaches, mezzanine loan defaults, and commercial mortgage foreclosures.

• Represented media company in antitrust action in federal district and appellate courts.

• Represent former CEO of technology company in litigation involving claims for breach of fiduciary duty and misappropriation of trade secrets.

• Represented several companies through Tax Court trial in which IRS sought to disallow millions of dollars of claimed losses arising out of foreign exchange derivatives (matter handled prior to joining Olshan).
