Took Six Years Long Years with Poor Results

About two years before the COVID-19 pandemic, my unfortunate mother was given amoxicillin for her nasal issue, but her medical records clearly states that she is allergic to penicillin, which includes amoxicillin. She had a delayed reaction that night where her entire body swelled up, including her f...ace, all causing her great pain. We took her back to the same hospital where she she was given the medication and they were eventually able to reduce the swelling and pain. Unfortunately, this was the second time my mother experience this identical medical malpractice, but with a different physician. This time however we decided to pursue a lawsuit against the doctor for medical malpractice. I found Eric and his late father here on Avvo due to proximity and that they they "can call upon the support of his Chinese speaking paralegals to assist us in our representation of Chinese speakers who need our help." The "his"is referring to the immigration attorney, whom Eric share his office space with. Because I live an hour away in NJ, I wanted her to work with an attorney who was close by and can communicate with her in either Cantonese or Mandarin. Upon our first meeting, I distinctly remember how dreary and dated the entire office was. Everything was brown, dark, and stuck in the 1970s. Despite the office aesthetics, my mother and I first spoke with Eric's father, who was the head of their father-son firm. Right away, the late Mr. Lutwin was dismissive and arrogant during our conversation. I remember asking him how successful was he at malpractice suites and was expecting his win-lost ratio or percentage, but instead he replied to the effect of, "I have boats to show you how successful I am." We should have walked out at that moment, but Eric interjected and began speaking for his father. Eric was much more comforting and professional than our brief experience with his father. Because of Eric's demeanor, he was able to convince me to continue with their legal service. Days, weeks, and months later, we were dealing with Eric's father, but we saw no progression with our case. Then Mr. Lutwin passed away before the pandemic, leaving Eric with the firm's entire case load. The pandemic shut down all of NYC's courts for a long while and Eric stated that he was heavily involved with a friend in need, along with the passing of his father, there was still very little news about my mother's malpractice suit. At this point it's been over three years of stagnation. This should've been an open and shut case, but there were things that neither my mother nor I understood, despite Eric's attempt to explain the reasons for the slow progress. After six long years, Eric and the doctor's insurance company settled for a paltry $75k, where 25% went to Eric and his one-person law firm. Bottom line, despite how "nice" Eric is as a person, we did not get great representation or results. This litigation took six long years where it should have been closed with one year. I am very sorry to my mother for hiring Mr. Lutwin and Eric. I should have followed my gut feeling and left their dingy office on that fateful day.
