Better off with a PD
I never ever would recommend a "public pretender" but if it came down to Mr. Hark and a PD; I would 100% go with a PD. I hired Mr. Hark for a family member incarcerated. I have been practicing law 20 years and have opened over 4677 civil, criminal, workers compensation, or municipal court cases. I can not address the comments of this individual because s/he did not identify themself, never called my office to discuss why s/he was not happy, nor met with me personally to discuss the concerns s/he had. There are many times when, regardless of the efforts I take, the facts are the facts, and based on those facts and the defendant's prior criminal history, the prosecutor's office may not extend a plea agreement acceptable to the client. However, if and when the client pleads guilty he is informed of his right to trial, and right to call witnesses on his behalf, and that s/he is waiving that right in exchange for any proposed plea agreement that is offered. We do not and have never guaranteed any results, merely that my office while do everything lawful and ethical to secure the best possible results for each client given their individual circumstances at the time I am hired. Remember, prior criminal history, prior pending charges, prior drug use/ history of addition, and or violations of parol and probation, often times dictate how much the prosecutors' office are willing to negotiate with defendants. Also the most important aspect of any relationship is open lines of communications and mutual respect. Obviously, those did not exist in this case.
