Asked if a specifice small claims suit was tort or breach of contract. He never answered my question, just told me why I should hire a lawyer)
That is actually not at all true. I directly answered your question. You asked if you could sue in contract or tort for a bad credit report. I explained that you could do neither, because the Fair Credit Reporting Act prohibits direct actions for bad credit decisions, and requires instead that you first send a Credit Reporting Act letter, explaining the error and requesting a research and correction. I also explained that this is a complex area of the law and that I have not seen successful resolutions of these cases when handled pro se. This would be especially true and a) the credit victim tries to sue directly without first sending a Credit Reporting Act letter and b) gets upset when an attorney explains how the law works and provides solid, real advice on how to move forward.
