Not many attorneys ever actually succeed in bringing a case to the Supreme Court's attention, let alone argue it or win it. Prior to this case, trial courts routinely refused to honor settlement agr ... eements in foreclosure cases when the borrower wanted to enforce the modification breached by the mortgage servicer. Mr. Denbeaux successfully brought this matter from the trial court through the Appellate Division and up to the Supreme Court. In 2017, the Supreme Court ruled in favor of the borrower. It is an important case, and the Seton Hall Center for Justice took on the case after and is now prosecuting Ms. Willoughby's rights in a separate proceeding against the wrongdoing bank. Empowering clients by turning the tables on banks, car sales companies and other predatory financial entities is one of the things that Mr. Denbeaux enjoys the most about the practice of law.
