Stacey A. Simon

Stacey Simon has extensive experience in all areas of immigration law, with emphasis on employment based and family based petitions. She represents U.S. and multinational employers in connection with all aspects of employment matters related to U. S. immigration laws and regulations, including: H-1B, L-1, E-1/E-2, O-1, O-2, P-1, P-2, P-3, EB-1 (Extraordinary Ability, Outstanding Researcher/Professor and Multinational Manager), National Interest Waiver petitions, Schedule A applications for Nurses and Physical Therapists, as well as adjustment of status applications, naturalization applications, and PERM Labor Certifications. She has handled appeals and other matters in proceedings before U.S. government agencies, including:

The Department of Homeland Security
The Executive Office of Immigration Review
The Department of State
The Department of Labor
Ms. Simon provides ongoing advice, counsel and training with respect to E-Verify, Form I-9 compliance, maintenance, audits, and corrective measures to mitigate fine, as well as negotiate with government officials to reach settlement agreements to reduce fines. She also counsels and trains clients on compliance and maintenance of documentation as required by law for non-immigrant visas. Ms. Simon has coordinated and overseen several large scale audits for corporate clients by various government agencies including ICE (I-9 audits) and the Department of Labor (Public Access File audits associated with H-1B filings).

Ms. Simon also has extensive experience in counseling clients on immigration-related due diligence in connection with mergers & acquisitions and other corporate restructurings.

Ms. Simon also represents many clients in connection with EB5 applications, with regard to both individual investments and investments in Regional Centers. Specific expertise includes: the sourcing of funds to the satisfaction of the Immigration Service, review of subscription agreements to ensure proper exit strategies, and liaising with Regional Center Counsel regarding feasibility under immigration law.

Ms. Simon has also represented several clients with regard to successful Section 13 filings. Section 13 is an uncommon relief sought by a person in the U.S. on a diplomatic mission, who has been terminated and can no longer return to their home country for fear of persecution. With a cap of 50 per year, these are uncommon but vitally important applications.

Ms. Simon has spoken at various panels as a subject matter expert for the American Immigration Lawyers Association, and for the Real Estate Developers of Staten Island (EB5 Regional Centers). Ms. Simon has also published several articles and practice advisories.
